Compromise Agreement
COMPROMISE AGREEMENT SOLICITORS EAST LONDON
Leaving a job, for whatever reason is an uncertain time. Many employees change jobs on good terms, others do not. It rarely benefits an employee in “moving on” to become embroiled in a long and risky employment tribunal case even where you have a strong sense of injustice or mistreatement by your employer.
Ina ll these situations, a compromise agreement, where available and offered by the employer, can provide a means to an end, a way of obtaining an enhanced termination payment which provides some breathing space to clear the head, to regroup and to start searching for the right next job without the immediate pressure of finances.
We provide rapid and experienced independent advice to employees which is generally free because with compromise agreements, it is pretty standard for the employer to pay your frees up to a maximum of £300.00 plus VAT. Unless significant negotiations on the terms of the agreement are needed, this will normally fully cover you on costs.
The benefit of instructing employment solicitors who deal regularly with compromise agreements is in knowledge of the likely “going rate” for the ex-gratia part of the package and in potentially negotiating a better package although this may not be possible. It all depends on the circumstances.
What circumstances usually result in a Compromise Agreement ?
One of the perhaps stranger things about compromise agreements (which are the only way of obtaining certainty and finality with potential employment disputes) is that they are offered in a very wide range of circumstances and the amount offered, for largely technical reasons, tends to be within a similar range notwithstanding the underlying circumstances.
Compromise agreements are offered where a grievance is raised, an employee has been or remains off work on extended sick leave, in redundancy situations or where there is a general breakdown in the relationship of trust and confidence between employer and employee.
